Privacy notice - Financial Assessment survey
Overview
This Privacy notice covers the survey about Financial Assessments being sent by the Adult Social Care's Financial Services department.
Along with other people, you have been selected to take part in that survey because you've had a Financial Assessment within the last three months or so.
East Sussex County Council takes data protection seriously. Please be assured that your information will be used appropriately in line with data protection legislation, will be stored securely and will not be processed unless the requirements for fair and lawful processing can be met.
What information is being used?
In this survey we will ask you for your feedback on the Financial Assessment that you had with East Sussex County Council. Completing the survey is optional and to keep the responses as non-identifiable as possible, please do not provide personal information such as your name, date of birth or address in your answers.
A code has been provided on all postal surveys, your response will be treated as anonymous, unless we need to identify you using the code to:
- send you the results of the survey as requested by you
- update your client, or carer, record in our database
- look into an issue or complaint that you have made it clear you would like us to try and sort out
- investigate a safeguarding concern if the response suggested that your, or someone else’s, health or safety was at risk.
If we receive your response by post, your survey response will be inputted onto our online consultation hub.
If you complete the survey online, Delib, our data processor will collect your IP address and if you choose to receive a copy of your response to the survey you will need to provide your email address. You can read more in our privacy notice for the consultation hub.
You are asked to provide your email or postal address if want to receive the results of the survey.
The ‘About You’ section of the survey asks you to share your personal equality information with us. This covers your: age, sex, gender reassignment status, post code, ethnicity, disability, faith or religion, sexual orientation, and whether you are married or in a civil partnership.
We ask the 'About You' questions because we want to make sure that everyone is treated fairly and equally and that no one gets left out.
How will your information be used?
The responses that you provide will be used to identify what is going well and what can be improved for people completing Financial Assessments.
We will use your information to send you the summary results of the survey if you opt-in.
Your ‘About you’ equalities information will be reported anonymously in the results report.
We will access your client, or carer, record if we need to:
- update your record in our database
- look into an issue or complaint that you have made it clear you would like us to try to sort out
- investigate a safeguarding concern if the response suggested that your, or someone else’s, health or safety was at risk.
We aim to maintain high standards, adopt best practice for our record keeping and regularly check and report on how we are doing. Your information is never sold for direct marketing purposes.
Our staff are trained to handle your information correctly and protect your confidentiality and privacy.
Your information is processed in the UK or in a country with an adequacy agreement with the UK.
What is the legal basis for processing your information?
Your data is processed under the legal basis of being necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
We would only send you the summary results of the survey if you opt-in to receive it.
We collect and process your equality information to enable us to comply with a legal obligation. The public sector Equality Duty means that we have to consider all individuals when carrying out our day-to-day work – in shaping policy, in delivering services and also in relation to our own employees.
We have a statutory duty to safeguard adults in East Sussex. This duty covers any processing of your information to look into a safeguarding concern.
We would only look into an issue or complaint where you make it clear that you wish us to do so.
How long will your information be kept for?
Your client, or carer, record will be retained according to our adult social care privacy notice.
All the individual responses would then be deleted, although we do retain the anonymised results reports.
Sharing your information
We won’t share the email or postal address you provide to receive the survey results.
We won’t share your individual ‘About You’ information. It will only be reported as part of anonymous group statistics.
We may share your information internally in order to raise a safeguarding concern or resolve an issue or complaint. We won’t share your information externally unless you give us permission to do so in order to resolve an issue or complaint.
Any sharing of personal data is always done:
- on a case-by-case basis
- using the minimum personal data necessary
- with the appropriate security controls in place
- in line with legislation.
Information is only shared with those agencies and bodies who have a "need to know" or where you have consented to the sharing of your personal data to such persons.
We may use the information we hold about you to assist in the detection and prevention of crime or fraud. We may also share this information with other bodies that inspect and manage public funds.
Your rights
Under data protection legislation, you have the right:
- to be informed why, where and how we use your information
- to ask for access to your information
- to ask for your information to be corrected if it is inaccurate or incomplete
- to ask for your information to be deleted or removed where there is no need for us to continue processing it
- to ask us to restrict the use of your information
- to ask us to copy or transfer your information from one IT system to another in a safe and secure way, without impacting the quality of the information
- to object to how your information is used
- to challenge any decisions made without human intervention (automated decision making)
