Rights of way searches

Your solicitor will carry out an official search to check if a property is affected by a public right of way. There are different types of searches so please consult your solicitor about this and also bear in mind that public rights of way are not always obvious on the ground. Please also see our Definitive Map and Statement page.

When a property changes hand the right of way will not be affected and will remain a legally recorded public highway. If land is subject to development and a legal Order is made as part of the planning permission a right of way may be changed of closed.

To apply for a search, please email us outlining your request and attaching a plan, clearly indicating which land you would like us to search the register for. Searches cost £20.40 (inc VAT) and can be paid for by cheque (made payable to East Sussex County Council) or online.

Commons and town or village green searches

Searches can also be carried out to check whether a property is on or near registered common land or a village green. Again, you should consult your solicitor about this.

To apply for a search, please email us outlining your request and attaching a plan, clearly indicating which land you would like us to search the register for. Searches cost £20.40 (inc VAT) and can be paid by cheque, made payable to East Sussex County Council.
