Privacy notice - Parking services


This privacy notice covers how we use your information, the reasons for doing so, and what rights you have in connection with the information we hold about you. We collect personal data for the following purposes:

  • administration of the parking scheme, permits and pay and display
  • for the issuing of Penalty Charge Notices (PCNs) by way of handheld devices or CCTV, challenges for the recovery of vehicles and debt in Persistent Evader operations
  • consultation on proposed developments to parking schemes in East Sussex
  • applications for or queries about access protection markings (APMs)
  • applications for or queries about disabled parking bays
  • applications or requests for new or changes to existing parking controls

East Sussex County Council takes data protection seriously. Please be assured that your information will be used appropriately in line with data protection legislation, will be stored securely and will not be processed unless the requirements for fair and lawful processing can be met


Parking scheme administration, permits, pay and display, Penalty Charge Notice (PCN) management and recovery of debt and charges associated with PCNs

To effectively manage the parking scheme, issue permits and manage pay and display parking we will ask for one or more of the following:

  • your name
  • your address
  • your vehicle registration number
  • payment details
  • proof of address
  • proof of vehicle use
  • proof of business

Consultations

In order to complete consultations we will ask for:

  • your name
  • your address, and
  • whether you consider yourself to have a disability

Access protection markings and disabled parking bays

We use the information you have provided us about your application for disabled parking bays or APMs. This may include your name, address, email address, phone number, date of birth, vehicle details, blue badge number, V5C or Mobility Hire Agreement, benefit details and disability.

Requests for new parking controls

We will ask for your name, your address, and email address. The provision of your telephone number is voluntary.


Parking permits

Your information will be used to check and confirm eligibility, make payments and the ongoing management for the life of the permit. This will ensure fair and consistent approach to the issuing of permits and reduce the potential risk abuse.

Card payment details will be used to process payments and refunds.

Your vehicle registration number and permit details will be used by Civil Enforcement Officers and members of the parking team when checking and enforcing parking restrictions.

Pay and display

Your vehicle registration number will be used to validate pay and display parking. Card payment details will be used to process payments and refunds.

Penalty Charge Notice (PCN) management and debt recovery

Your information will be used to manage the legislative progression and appeal process of PCNs, as set out in the Traffic Management Act 2004 (TMA2004) and the Transport Act 2000 for bus lane PCNs. Where PCNs are not paid or challenged your information will be used by our notice processing team and contracted enforcement agencies to recover all debts and charges associated to PCNs.

Consultations

We will collect your name and address to identify any duplicate responses to the consultation. This will ensure a fair and democratic consultation that most accurately reflects the opinions of residents, businesses and other stakeholders. This information will not be used in any reporting, it will only inform accurate data collection.

Information on whether you consider yourself to have a disability is collected and reported on to identify the potential need for disabled parking facilities within the area.

Access protection markings and disabled bays

Your information will be used to help us assess your application, to contact you to discuss your application, organise payment where applicable and to make the necessary arrangements for completion of the work. We may also contact you about the markings after completion. For example, if we receive a request to remove a disabled bay from another member of the public or need to check the validity of the bay, we will need to contact you to check you still need it.

Requests for new parking controls

Information will be used to keep customers up to date with the progress of their request, to contact them to ask for more information where necessary, to know the exact location of the request, and to assess the level of local support.

In all circumstances we aim to maintain high standards, adopt best practice for our record keeping and regularly check and report on how we are doing. Your information is never sold for direct marketing purposes.

Our staff are trained to handle your information correctly and protect your confidentiality and privacy.

Your information is processed in the UK or in a country with an adequacy agreement with the UK.

The processing of personal information is required to effectively manage our parking schemes. The Council has a statutory duty to manage parking on our civil parking enforcement areas. Processing is necessary for compliance with a legal obligation under the Traffic Management Act 2004 and Transport Act 2000.

East Sussex is exercising official authority (for example, a public body’s tasks, functions, duties or powers) which is laid down by law.

Consultations

The processing of your data is carried out on the basis of legitimate interest in the task. Our consultations provide residents, businesses and other stakeholders the opportunity to comment on proposals which may impact them in the future. The processing of data is necessary to achieve accurate and informed results. The minimum amount of data is collected and used only for this purpose.

Access protection markings and disabled bays

We process your information because it is necessary for the performance of a task which is carried out in the public interest or as part of the Council’s official functions. In this case, responding to your request for a disabled bay or access protection markings.

Requests for new parking controls

Processing is necessary for the performance of a task carried out in the exercise of the Council’s official authority. In many cases, consent to process data will be requested. Recording the personal information detailed earlier ensures the smooth running of a service requested by the customer. Information is only used in ways that the customer would reasonably expect.


Parking scheme administration

For the effective management of the parking schemes information will be held in line with our retention schedule.

Permits

Information held for one year after permit account is no longer required (for example, resident moves away).

Pay and display

Vehicle registration number information will be kept for 12 months. Financial information will be kept for 6 years.

Penalty Charge Notice (PCN) management and debt recovery

Non-financial information will be kept for one year after PCN closed.

Financial information will be kept for 6 years after PCN is closed.

Witness statements will be kept for 6 years after PCN closed.

Enforcement agent records for 2 years after PCN closed.

Consultations

Your personal data is kept for 18 months.

Access protection marking applications

We will keep details of your application for 6 years after the end of the financial year in which the marking was installed or the application rejected. Disabled bay applications

We will keep details of your application for 6 years after the end of the financial year that the bay was installed or when the bay ceases to be used or when the application was rejected if sooner. Where a bay is installed, we will keep your contact details, the location of the bay and when it was installed until we receive confirmation that the bay is no longer in use by the original applicant.

Please let us know if any of your details change.

Requests for new parking controls

Information is kept for 6 years and then deleted manually from spreadsheets and automatically from online forms. Paper copies are disposed of as confidential waste.


Your data will not be shared unless we are required to by law, such as if a Freedom of Information or similar request is made. We may also share your details with other East Sussex County Council teams or our contractors in order to provide you with the best possible service.

Any sharing of personal data is always done:

  • on case-by-case basis
  • using the minimum personal data necessary
  • with the appropriate security controls in place
  • in line with legislation

Information is only shared with those agencies and bodies who have a “need to know” or where you have consented to the sharing of your personal data to such persons.

We may use the information we hold about you to assist in the detection and prevention of crime or fraud. We may also share this information with other bodies that inspect and manage public funds.

Use of third party organisations

To enable us to provide the services requested, East Sussex County Council may share your information with trusted external organisations to process your data on our behalf.

Any organisation commissioned by the Council will be under contractual obligation to comply with data protection legislation.


Under data protection legislation, you have the right:

  • to be informed why, where and how we use your information
  • to ask for access to your information
  • to ask for your information to be corrected if it is inaccurate or incomplete
  • to ask for your information to be deleted or removed where there is no need for us to continue processing it
  • to ask us to restrict the use of your information
  • to ask us to copy or transfer your information from one IT system to another in a safe and secure way, without impacting the quality of the information
  • to object to how your information is used
  • to challenge any decisions made without human intervention (automated decision making)
