Privacy notice - Booking system for the household waste recycling sites
Overview
This privacy notice covers all users of the household waste recycling site service and its booking system. It is for the purpose of making a booking before visiting a site.
East Sussex County Council takes data protection seriously. Please be assured that your information will be used appropriately in line with data protection legislation, will be stored securely and will not be processed unless the requirements for fair and lawful processing can be met.
What information is being used?
We will collect the following data:
- vehicle registration number
- name and address of the person bringing the waste
- name and address of the person's waste to which it belongs (if different)
- date and time of visit
- site visited
- waste quantity type (trade waste enforcement check)
- company and brand of vehicle (trade waste enforcement check)
- company name displayed on vehicle livery (trade waste enforcement check and if applicable)
- charity organisation (if applicable)
- hire vehicle details (if applicable)
- method of visiting the site - car, van, pedestrian, cyclist, taxi
How will your information be used?
This information is required for enforcement purposes. It is to ensure that you are not using our household waste recycling site to illegally dispose of commercial waste. This information may be used to contact you if we have concerns about how you are using our recycling sites.
Our sites are for the use of East Sussex residents. The booking system will enable us to identify bookings from outside the county. These users can still book to use a site but will be required to pay an out-of-county charge.
We aim to maintain high standards, adopt best practice for our record keeping and regularly check and report on how we are doing. Your information is never sold for direct marketing purposes.
Our staff are trained to handle your information correctly and protect your confidentiality and privacy.
Your information is processed in the UK or in a country with an adequacy agreement with the UK.
What is the legal basis for processing your information?
Your information is processed under Article 6(1)(e) of the GDPR to enable the Council to act in the public interest, and in accordance with the Environmental Protection Act 1990 when providing this service to the public.
We do not have a duty to accept commercial waste at these sites or accept waste fr`om non-East Sussex residents.
Visitors with commercial type vehicles (such as vans) may be bringing commercial waste to our sites. Monitoring van usage helps to prevent illegal disposal of waste. See also our privacy notice on van users at our household waste recycling sites.
How long will your information be kept for?
The information for bookings made by East Sussex residents will be held for 18 months.
Bookings requiring an out-of-area access charge will be held for 6 years in line with ESCC financial regulations.
Sharing your information
It is sometimes necessary to share information with contractors and other public bodies involved in providing waste services to residents in East Sussex.
Many of these organisations are involved in investigating illegal waste activities and taking enforcement action against people involved in these activities.
Any sharing of personal data is always done:
- on a case-by-case basis
- using the minimum personal data necessary
- with the appropriate security controls in place
- in line with legislation.
Information is only shared with those agencies and bodies who have a "need to know" or where you have consented to the sharing of your personal data to such persons.
We may use the information we hold about you to assist in the detection and prevention of crime or fraud. We may also share this information with other bodies that inspect and manage public funds.
Use of third party organisations
East Sussex County Council may share your information with trusted external organisations to process your data on our behalf.
- Veolia, who are contracted to operate household waste recycling sites in East Sussex and Brighton & Hove, and whose staff are responsible for collecting this information.
- Brighton & Hove City Council, who are our partner in the PFI contract with Veolia and are responsible for waste enforcement in their area.
- Eastbourne Borough Council, Hastings Borough Council, Lewes District Council, Rother District Council and Wealden District Council, to share intelligence and co-ordinate enforcement action against people suspected of illegally disposing of waste in their areas.
- Environment Agency, who act as the waste regulator.
- Sussex Police, in serious incidents where criminal offences may have been committed.
Any organisation commissioned by the Council will be under contractual obligation to comply with data protection legislation.
Your rights
Under data protection legislation, you have the right:
- to be informed why, where and how we use your information
- to ask for access to your information
- to ask for your information to be corrected if it is inaccurate or incomplete
- to ask for your information to be deleted or removed where there is no need for us to continue processing it
- to ask us to restrict the use of your information
- to ask us to copy or transfer your information from one IT system to another in a safe and secure way, without impacting the quality of the information
- to object to how your information is used
- to challenge any decisions made without human intervention (automated decision making)
