Privacy notice - Employment and Skills team
Overview
This Privacy notice covers the processing of personal data carried out by the East Sussex County Council Employment and Skills Team (Careers Hub, Transform Service, Steps to Success, Connect to Work programme, Skills Bootcamps, Adult Learning programmes, Work Experience Service, Skills and Employment East Sussex and associated task and working groups).
If you are engaging with or going into a school/college or young person’s setting, please also see the education provider or organisation’s privacy notice. They may retain information about adults going in to work with children on their single central record for safeguarding reasons.
East Sussex County Council takes data protection seriously. Please be assured that your information will be used appropriately in line with data protection legislation, will be stored securely and will not be processed unless the requirements for fair and lawful processing can be met.
What information is being used?
The Employment and Skills Team provide a coordinated approach to employer engagement across our teams (Careers Hub, Transform Service, Steps to Success, Connect to Work Programme, Skills Bootcamps, Adult Learning programmes, Work Experience Service, Skills and Employment East Sussex and associated task and working groups). We may collect details about your organisation, such as name, job title, organisation, email address, phone number.
If you are an Employer working to support careers activities and/or work experience, employment support initiatives, adult learning programmes and recruitment opportunities (jobs, placements, apprenticeships, etc.) or strategic initiatives through Skills and Employment Sussex and its associated task groups and working groups: we may collect your name, address, job title, membership of professional body, telephone number, email address, and photographs of participation in events as part of your role.
If you are an Enterprise Adviser working in schools and colleges, we will also process your qualifications, DBS reference number and issue date.
We may also collect or process your special category data, such as health or access needs, in order to better meet your needs for attendance at meetings and training.
How will your information be used?
We hold your information to deliver the projects and services which the Employment and Skills team is responsible for. We also use it to maintain records of participation in activities as part of your role as part of our statutory duties or to ensure the safeguarding of young people.
We aim to maintain high standards, adopt best practice for our record keeping and regularly check and report on how we are doing. Your information is never sold for direct marketing purposes.
Our staff are trained to handle your information correctly and protect your confidentiality and privacy.
Your information is processed in the UK or in a country with an adequacy agreement with the UK.
What is the legal basis for processing your information?
Information is processed under Article 6(1)(e) Public Task of the UK General Data Protection Regulations (UK GDPR).
Special category data is processed under Article 9(2)(g) of the UK General Data Protection Regulations (UK GDPR) in order to better meet your needs and access requirements.
How long will your information be kept for?
Your information will be held for up to 10 years or as per the requirements of the funding associated with the project you are involved with.
Any photos taken as part of your engagement and work with the Employment and Skills Team will be stored and used for 2 years, and specific separate consent will be sought.
Sharing your information
Information may be shared in circumstances where we are obliged to share information owing to a legal or statutory obligation.
We sometimes disclose non-identifiable information about dietary and access needs to event providers. We may share your email address, for example, with the relevant school so that you can be contacted and develop a working relationship.
Any sharing of personal data is always done:
- on a case-by-case basis
- using the minimum personal data necessary
- with the appropriate security controls in place
- in line with legislation.
Information is only shared with those agencies and bodies who have a "need to know" or where you have consented to the sharing of your personal data to such persons.
We may use the information we hold about you to assist in the detection and prevention of crime or fraud. We may also share this information with other bodies that inspect and manage public funds.
Use of third party organisations
East Sussex County Council may share your information with trusted external organisations to process your data on our behalf.
Your information may be shared with the Department for Education, the Careers and Enterprise Company, schools or colleges and relevant organisations such as the National Careers Service. We may also share your name, business and details of things you have achieved in your role with the press for publicity purposes, explicit consent will be obtained to do so.
If you are an Enterprise Adviser, for the benefit of the network, we also share with other Enterprise Advisers your name, company and sector, contact details, and skills and strengths as provided by you on your contact information sheet.
Personal data is stored on a platform provided by First Media.
Any organisation commissioned by the Council will be under contractual obligation to comply with data protection legislation.
Your rights
Under data protection legislation, you have the right:
- to be informed why, where and how we use your information
- to ask for access to your information
- to ask for your information to be corrected if it is inaccurate or incomplete
- to ask for your information to be deleted or removed where there is no need for us to continue processing it
- to ask us to restrict the use of your information
- to ask us to copy or transfer your information from one IT system to another in a safe and secure way, without impacting the quality of the information
- to object to how your information is used
- to challenge any decisions made without human intervention (automated decision making)
