New consumer rules – honest traders have nothing to fear

New regulations coming into force this week aim to provide better protection for consumers – but honest businesses have nothing to fear, says East Sussex County Council.

Council leaders are highlighting the issue and say that everyone who deals with consumers will be affected, from retailers to builders and second-hand motor traders.

The Council’s Trading Standards Service is reminding businesses about the new rules – called the Consumer Protection from Unfair Trading Regulations – which came into force on Monday 26 May 2008. The regulations replace many detailed rules around trade descriptions and misleading prices with a general ban on unfair trading. They also put a stop to aggressive selling techniques and misleading people about products and services.

Councillor Bob Tidy, Lead Member for Community Services at the County Council says that the new rules will protect consumers and support businesses. “Honest traders will no longer have to face unfair competition from companies that use underhand practices,” said Councillor Tidy. “The changes also simplify consumer protection across the UK and in the rest of the EU, making it clear which commercial practices are allowed.

“We know that the vast majority of businesses in East Sussex already deal fairly with their customers and they may not need to change the way they work at all. But to make sure they are complying with the new rules, business people and their staff should read and understand the regulations.”

Businesses that do not comply with the regulations may be investigated by Trading Standards and other agencies. Trading Standards officers warn that legal action could be taken against a company that doesn’t comply with the new rules – which could lead to a fine and possible loss of customers.
